- W2289469595 abstract "Section 302 of the Labor Management Relations Act broadly prohibits, …any employer...to pay, lend, or deliver, any money or other thing of value...to any labor organization, or any officer or employee thereof, which represents, seeks to represent, or would admit to membership, any of the employees of such employer… In Mulhall v. UNITE HERE, the United States Supreme Court was confronted with whether a card check neutrality agreement runs afoul of these types of agreements. While the Court dismissed the cert petition as improvidently granted following oral argument, this nonetheless leaves a split in the Circuits on this issue with the Third and Fourth Circuits finding Section 302 to not be implicated and the Eleventh Circuit finding in the affirmative. In this article I will trace the histories of Section 302 and card check neutrality agreements. I will discuss how different courts have treated the application of Section 302 to card check neutrality agreements. Then I will look at the attempts to resolve the conflict between Section 302 and card check neutrality agreements by first looking at the issues of intent and whether card check neutrality agreements are covered by Section 302. Finally, I will propose looking at extrinsic evidence to decide on a case by case basis whether card check neutrality agreements run afoul of Section 302." @default.
