- W2299680154 abstract "This note seeks to reconcile the ever-evolving need for a dynamic allocation of war powers between the legislative and executive branches in the age of fourth-generational warfare, with the static constitutional commitment of the “declare war” power to Congress and the “commander-in-chief” power to the President. Part I of this note reviews the legal and historical foundations of both the pure Congressionalist and pure Presidentialist approaches and explains why both positions are untenable. Part II considers the third, median view that the Constitution commits different war powers to the legislative and executive branches and explains why this position is incomplete. Part III describes the Westphalian system of nation-states ascendant at the time of the Founding and explains what the Framers understood to be the powers of war and peace, an understanding which no longer applies fully to the modern world. Finally, Part IV offers a different theory of war powers by expounding upon the implications of the advent of the fourth generation of warfare (with its increased legal, political, and military asymmetry among opponents, and its obfuscation of the line between peace and war or civilian and military) for the allocation of war powers between the legislative and the executive, in an effort to refine that view into an effective guide for Congressional and Presidential war action in the modern world." @default.
