Nazi jurists recognized compulsory sterilization for eugenic reasons (Congenital Health Law of 1933) but this has since been discredited and has complicated the question of sterilization since certain regulations concerning voluntary sterilization were and are contained therein. After World War 2 the ruling opinion was that culpability in voluntary sterilization must be decided by the penal law code which contained the much disputed provision 226a that sterilization for medical or genetic reasons is allowed but for social indications illegal when contrary to good custom (morality) a concept extremely difficult to define. In the much criticized Dohrn decision of 1964 the Gerichtshof (highest penal court of Germany) ruled that the penal law code could not be used in questions of voluntary sterilization but that there was a legal gap on this question which only the jurists could close. It is unclear in this confused situation whether a doctor who sterilizes for social indications is penally responsible or not. According to current discussion on the subject the following are indications for sterilization: medical-therapeutic reasons (treatment of a disease or disorder); medical-prophylatic reasons (when pregnancy or birth would seriously endanger life or health); eugenic (genetic) indications; and grave social reasons as the 1969 Session of German Practitioners advocated. This last position is still vague. In parts of Germany a committee must help the doctor decide on the legality of a medical-prophylactic sterilization. In a voluntary sterilization the doctor must inform the patient of the risks and consequences and the woman must be legally competent to comprehend and make a decision. In the case of mentally handicapped persons the doctor must always consult a court of guardianship. Recently the authors of the Alternative Draft for a penal code have recommended sterilization by choice for any indication for all over 25 after professional consultation." @default.
