- W2308098548 abstract "Unsurprisingly, concerns have been raised ‘about the capacity of law to be flexible and manage for the dynamics of linked social-ecological systems.’ Indeed, it has been pointed out that ‘[a] legal system that is linear and largely static is ill-suited for the nonlinear dynamics of linked social-ecological systems.’ This concern has also been raised in relation to the international legal system. An important segment of each legal system, also at the international level, is decision-making by (quasi-)judicial bodies, such as the International Court of Justice (ICJ) or the World Bank Inspection Panel (WBIP, IP). (Quasi-)judicial bodies play an integral role in the interpretation (and thus the making) of international law, given that ‘[t]he meaning of norms is the product of legal practice.’ This particular role of (quasi-)judicial bodies then raises the question whether and to what extent the above-mentioned concerns are applicable to them. Are they able and capable to bring flexibility into the legal system, and thus be resilience-supportive? It is often argued that law, and in particular (quasi-)judicial bodies, are often seen as ‘deterrents to implementing adaptive management’. Indeed, (quasi-)judicial bodies aim to ensure legal certainty and make a final assessment of the legal dispute, both of which seem to contradict the requirement of flexibility. Accordingly, this apparent controversy leads to the question whether and to what extent international (quasi-)judicial bodies are able and capable to balance the arguments from a resilience-driven perspective when they assess (potential) harm relating to natural resources. In order to answer this question, the chapter relies on a case study: it will analyse the extent of resilience-friendliness of international (quasi-)judicial practices in water-related disputes. Due to the transboundary nature of many water resources, international law and management at the international or global level play an important role in maintaining their resilience. The analysis scrutinizes some of the water-related cases of the WBIP, the Arbitral Tribunals of the International Centre for Settlement of Disputes (ICSID) and the ICJ. While the first is a quasi-judicial body, the last two can certainly be qualified as judicial entities. The analysis is extended to the WBIP in order to be able to assess any possible differences between judicial and (quasi-)judicial practices." @default.
