- W2308374118 abstract "While the language of natural (or human)rights continues to proliferate in contemporary discourse, theintellectual underpinnings of these rights has yet to progress in awidely accepted manner from the Rawlsian arguments thatprecipitated the most recent state of crisis in liberal thought.From the perspective of contemporary natural law theory, rights areindeed grounded and justified as expressions of a subjectiveperspective regarding the requirements of the natural law or thedemands of justice. While many rights may derive theirjustification solely from the requirements of a prior naturalmorality in this way, the partial detachment of subjective rightsfrom a prior moral structure effected by early liberal thinkerssuch as John Locke contains an important element of truth. Naturalrights, such as the rights to one’s life, liberty, and externalproperty, are primarily justified by human beings’ self-ownershipthrough self-consciousness. This notion is expressed, in animplicit and undeveloped manner, by Locke in his Essay ConcerningHuman Understanding and his Two Treatises of Government.Self-ownership, rightly understood, both underpins and justifiescertain natural rights independently of a prior natural morality,and serves as the basis for responsibility within a natural moralstructure. Indeed, a persuasive theory of the natural law isimplied by a proper understanding of the same self-ownership thatengenders natural rights. In this way, a properly articulatedunderstanding of self-ownership simultaneously justifies andexplains liberalism’s rights-based orientation, and provides apersuasive basis for supplementing natural rights-based moralitywith a natural law morality. Natural justice, of the sort thatjustifies and limits the actions of human governments and guidesthe activity of individuals, finds complementary bases in both theindividual human being and in the common characteristics ofhumanity. Natural rights and natural law, or modern and pre-modernorientations in moral and political philosophy more broadly, neednot be characterized in terms of opposition or even an order ofpriority; they are, rather, complementary elements that join toform a true conception of natural justice." @default.
