Employing an organization institutional approach, the study shows that there are empirically derivable decision rules to explain the behavior of USTR and that 301 implementation is neither a random exercise in American trade power nor a process driven by big interest groups. The conclusions of this article are drawn from the (approximate) universe of completed Section 301/302 investigations carried out by USTR between 1974 and 1989. Analysis of these 40 cases contradicts recent research analyses regarding 301 and export policy. Previous analyses, though containing grains of truth, mischaracterize the implementation of 301 policy by overstating the significance of strategic, “picking winners” industrial policy, by ignoring completely the crucially important GATT regime utility variable, and by characterizing 301 policy as the product of a “declining hegemon” or “diminished giant” syndrome when the market sector-specific evidence shows that the U.S. can be more aptly described as no longer a “benevolent hegemon” in agriculture and traditional manufacturing markets and an “ascending hegemon” in services and intellectual property-based markets." @default.
