- W2364543410 abstract "It is known in the world that labor right is one of the fundamental human rights. ″Citizens have the right to work″ is provided in all the previous Chinese constitutions. As a constitutional right, there are differences between the labor right under the legal relation of constitution law and the workers’ right under the legal relation of labor law. Therefore, it is essential in understanding to avoid the theoretical fallacy caused by logical converse deduction, which defines the meanings of labor right from the angle of legal relation of labor law, so as not to confuse the said two legal concepts.There are different understandings regarding the nature of labor right in Chinese jurisprudential circles and some countries and regions where the continental law system is adopted. Comparison with the labor right provisions in Germany, Japan and Taiwan (China) shows that discrepancies result from those in the normative form of the constitutional text, the purpose of labor right, etc. On the other hand, however, the understandings of the nature of labor right tend to converge. China’s labor right should present the dual nature of negative rights and social rights by constitutional interpretation in the transitional period.It is easier to reveal the connotation and function of labor right from another viewpoint of protection by ″integrated approach″:oriented typology of the State’s obligations. The typology of the State’s obligations consists of the obligation to respect, the obligation to protect and the obligation to fulfill, and fulfillment obligations include the obligation to facilitate and the obligation to provide. In case labor right is infringed in realistic life, it is very significant to analyze accordingly the obligations borne by the State.In current China, it is urgent to form a right balance system and reconstruct the mutual constitutionalistic recognition of social fairness and harmonious development through labor right, which embodies two horizontal levels-equal protection of property right and labor right, and strengthening of equality between the employer and the employees, and two vertical levels-increasing the number of representatives of laborers’ interest in policy-making and enhancing basic laborer capacity." @default.
