- W2414442775 abstract "The proliferation of constitutional provisions ensuring gender equality has been considered a moderate victory for the rights of women all over the world. Scholars have celebrated how constitutional courts have been instrumental in bringing about progressive social change, especially in the direction of greater gender equality. However, less attention has been paid to the specific ways in which the goal of gender equality is being pursued. This paper examines both the theoretical and practical difficulties of constructing gender equality within the context of a controversial case decided by the Korean Constitutional Court. The case involved a challenge to a statute that offered bonus points to military veterans applying for civil service where conscription is limited to male citizens only. The Court struck down the bonus point statute based on discriminatory impact alone, while exempting women's inclusion in mandatory military service. While people have celebrated the Court's decision as a progressive victory in a traditionally male-dominant society, I will argue that the compensative approach used by the Court runs the risk of entrenching existing gender stereotypes rather than achieving a more comprehensive gender equality. The Court's concern for immediate results has led to an endorsement of 'equality with exceptions' in the shorter-run thereby sacrificing the quest for 'full equality' between men and women in the longer run." @default.
