- W2415770974 abstract "Focus in this discussion of abortion and the law in 1980 is on the Supreme Court and lower court decisions before and after Roe v. Wade and Doe v. Bolton. Attention is directed to competing interests in the abortion controversy (the nature of the fetus the womans interest the role of the state) the Supreme Court decisions (precedents to Roe v. Wade and Doe v. Bolton federal district court decisions and statutory change medical and social indications for abortion)--Roe v Wade Doe v. Bolton and subsequent Supreme Court decisions (Planned Parenthood v. Danforth and Colautti v. Franklin) medicaid funding (Beal v. Doe Maher v. Roe and Poelker v. Doe; funding and the Supreme Court; the logical extension of Maher and its implications). In Roe v. Wade the Supreme Court held that the fundamental right of privacy encompasses a womans right in consultation with her doctor to obtain an abortion. In Doe v. Bolton the Supreme Court struck down a Georgia statute which allowed abortion only to protect the womans life or health in cases of rape or to prevent the birth of a deformed child. It also struck down the various requirements associated with obtaining an abortion indicating that these unduly burdened a womans right to decide whether to terminate her pregnancy. In Planned Parenthood v. Danforth the Supreme Court dealth with a statute which placed restrictions on abortions to the extent the Missouri Legislature thought the Roe and Doe decisions would permit. The Court agreed that the womans written consent could be required but it invalidated most of the other provisions of the statute based on the holdings of Roe and Doe. The Court stressed once again in Colautti v. Franklin that the decisions in Roe Doe and Planned Parenthood are to be read together as affirmation of the principles that the abortion decision belongs with the woman and her physician not with the state. There are certain pervasive themes to the Supreme Court decisions which show that the Court has not retreated from the basic view it took in those landmark cases." @default.
