- W2418673934 abstract "The Department of Health and Social Security in the UK issued a pamphlet asserting the lawfulness of nurse participation in the medical induction of abortion by use of the drug prostaglandin and the Royal College of Nursing sought a declaration from the court that what the Department said was wrong in law. At 1st instance the case was heard by a single judge who ruled that their involvement was legal. It was then taken on appeal by the College to the Court of Appeals who determined that such involvement was unlawful. Finally this decision was appealed by the Department who took the case to the House of Lords. The law lords held by a majority of 3 to 2 in favor of the view that the involvement of the nurses was legal and in the process upheld the view of the judge who had originally heard the case. In all 9 judges have dealt with this problem involving nurses and it is deemed important to review this case in detail. This is an English case that deals specifically with English legislation. Before the 1967 Abortion Act was passed in England it was regarded as an offense for any person with intent to procure the miscarriage of any woman unlawfully to administer to her or cause to be taken by her any poison or other noxious thing or unlawfully to use any instrument or other means whatsoever with the intent of procuring a miscarriage. These provisions affected nurses midwives pharmacists and others as well as physicians. Prior to the case of R.V. Bourne 1939 I.K.B. 687 it had been generally accepted that abortion was lawful where it was necessary to save the pregnant womans life. This law extended the meaning a little further. Dr. Bourne a well-known obstetrical surgeon invited prosecution by informing the authorities that he was going to perform an abortion on a 14 year old girl who had been the victim of a particularly brutal rape. As the law however was still uncertain and unsatisfactory the Abortion Act 1967 was enacted to clarify the situation. The law is recounted here as is a description of the procedure of medical induction by prostaglandin which was not in use in 1967 meaning that Parliament would not have had this type of situation in mind.
