Para tal, serao apresentadas as discussoes sobre acoes afirmativas e politica de cotas no Brasil, um panorama das teorias utilizadas para a analise de modelos educacionais relacionadas a trabalhos que utilizam como base cada quadro normativo para analisar a acao afirmativa no Brasil. As conclusoes encontradas sao que as tres teorias se diferenciam em sua origem, a teoria do capital humano tem origem na economia ortodoxa, a teoria dos direitos humanos a partir da discussao de normas e leis e a abordagem das capacitacoes surge como uma alternativa mais ampla que considera fatores intrinsecos e nao intrinsecos (economicos ou nao). Logo, por ser um modelo que nao apresenta limitacoes dos espacos informacionais e que permite analisar questoes de discriminacao e desigualdade, a abordagem das capacitacoes se mostra o quadro normativo mais adequado a avaliacao de politicas de acao afirmativa por trazer como objeto de analise questoes de discriminacao de genero, cor, situacao economica. Porem ainda existem poucos trabalhos que se utilizam de tal teoria para avaliacao de politicas devido a sua dificuldade de operacionalizacao. ABSTRACT The aim of this study is to analyze the affirmative action policy of quotas in universities in Brazil through comparison among three frameworks for evaluating educational policies: human capital, human rights and capability approach. To this end, discussions about affirmative action and policy of quotas in Brazil will be presented, an overview of the theories used in the analysis of educational models related to academic works using each framework as a basis to analyze the affirmative action in Brazil. In conclusion, the three theories differ in their origin, the theory of human capital has its origin in orthodox economics, the theory of human rights in the discussion of rules and laws and the capability approach appears as a broader alternative which considers intrinsic and not intrinsic factors (economic or not). Therefore, being a model that does not present limitations of informational spaces and allows analyzing discrimination and inequality issues, the capability approach has shown the most appropriate framework for the assessment of affirmative action policies for bringing as an object of analysis gender, color and economic status discrimination issues. There are still studies that do not use this theory for evaluation of policies due to its difficulty of implementation.
