- W2479893498 abstract "Before you can solve a problem, you must first understand it. Although both lawyers and scientists employ logic, lawyers apply logic in different ways than scientists. They have different viewpoints derived from law school. Lawyers are trained to respect precedent and the majority view. That viewpoint comes into play when they work with experts. They tend to accept an expert’s theory if they believe courts have previously recognized that theory as a proper basis for testimony. It is true that Daubert v. Merrell Dow Pharmaceuticals, Inc., formally abandoned the Frye general acceptance test. However, a close reading of Daubert reveals that trial judges are still supposed to consider general acceptance as a factor, and any realistic survey of the case law indicates that trial judges ascribe a great deal of weight to that factor. Of course, trial judges are most likely to be lawyers. In contrast, scientists revel at the prospect of shattering previously accepted principles. To name just a few, Newton, Einstein, Lister, Pasteur, Edison, and Jobs all pioneered breakthroughs that upset the conventional wisdom. Although the legal system usually progresses by a gradual refinement of long lines of precedent, the evolution of scientific thought is dictated by ongoing empirical research that often overthrows previous beliefs.
