Does it not run a severe risk of Anglocentrism (both in the light in which it casts other European states and in its vision of the Celtic nations within the UK)? The arguments implicit in these questions contain significant elements of truth. They are revealing — about UK ‘European’ politics, about the EU and indeed about Dicey and his legacy. Dicey is the font of the ‘modern’ public law tradition in England and hence of ‘modern’ English conceptions of sovereignty. Writing in the second half of the nineteenth century, Dicey witnessed a number of reforms which extended the franchise, leading commentators to take account of the importance of this new electorate in understanding the governmental system. For Dicey, this change posed a fundamental challenge to British constitutional theory. Whilst Bagehot and his followers had stressed the sovereignty of parliament as the essence of the British constitution, Dicey argued that behind Parliament lay a more fundamental source of power: the sovereignty of the people.
