On March 31, 1987, the Superior Court of Bergen County, New Jersey, handed down the verdict in the now famous ‘Baby M’ trial. This case was the first major court case concerning surrogate motherhood and the brokering of surrogate agreements, that attracted widespread attention from the national news media. Mary Beth Whitehead, who had signed a contract with Bill Stern to be artificially inseminated and to carry the foetus to term for the Sterns, opted instead to keep the baby girl. In the lawsuit that followed, Judge Sorkow of Bergen County decided to give sole custody to the father, denying Mary Beth Whitehead her ‘natural’ maternal rights, and thus upholding the surrogate contract.
