• W2547015125 abstract "이 논문은 절대적 기본권을 포함하는 기본권의 형량에 관하여 수학적 방법론을 적용한 연구이다. 이러한 수학적 방법론의 적용은 지금까지 제기되었던 형량의 자의성 내지 불합리성에 대한 우려를 배제하거나 최소화시키는 방편이 될뿐만 아니라, 형량과정의 명료성 및 객관성을 확보할 수 있다는 점에 그 유용성이 있다. 그러한 의미에서 이 논문은 기존의 형량불가론적 접근법의 주요 논거들, 이른바 절대적 기본권의 비교불가능성, 최우선성 훼손 및 상대화 문제, 형량 결과 도출의 불가능성에 대해 비판하였다. 그에 더해 비례성 원칙에 있어서의 형량 심사에 적용하기 위해 절대적 기본권의 형량에 관한 수학적 표현을 제시하였다. 동시에 절대적 기본권의 형량에 관한 연구와 관련하여 기본적인 문제로 거론될 수 있는 ‘절대적 기본권과 상대적 기본권 사이의 일반적 형량’ 및 ‘동일한 절대적 기본권 사이의 형량’이라는 주제들에 대해 중점적으로 다루었다. 이 논문의 형량 공식은 알렉시의 ‘중요도 공식’에 그 기반을 둔다. 그렇지만 알렉시의 공식에서처럼 세분화된 척도를 통한 형량의 대강만으로 만족하려는 것이 아니라, 무한대, 극한과 같은 수학적 개념들을 추가로 도입함으로써 형량과 관련된 기존의 논의에 비해서 수학적 계량화와 정확성이라는 측면에서 보다 더 심화된 이해를 추구하였다.This article aims at analysing the balancing of absolute fundamental rights by applying mathematical methodology. Balancing means weighing of the competing fundamental rights or principles proportionally, and absolute fundamental rights means the rights which can never be limited in any circumstances. So that the balancing of absolute fundamental rights is often and heavily criticized for some reasons - for example, incommensurability of absolute fundamental rights, loss of their top priority, and impossibility or difficulty of quantifying them. But this article tries to counter these criticisms by using mathematical methodology. First, it shows the process of balancing of how to value relative and absolute fundamental rights. Second, it explains the ‘general’ balancing between absolute fundamental rights and relative fundamental rights. Third, it suggests the solution of balancing problem in case of a collision of the same absolute fundamental rights. These approaches used in this article borrow from the idea of ‘Weight Formula’, which developed by Alexy. However, these accept some mathematical concepts of ‘infinity’ and ‘limit’ additionally, in order to quantify absolute fundamental rights and improve the accuracy." @default.
