Addressing most salient differences between interests of class members, Justice Ginsburg reasoned in majority opinion that for currently injured, critical goal is general immediate payments. That goal tugs against interest of exposure-only plaintiffs in ensuring ample, inflation-protected fund future. The Court affirmed Third Circuit's finding that an undivided set of representatives could not adequately protect discrete interests of both. Finding that requirements of Rule 23(a)(3) and (4) overlap because both look to potential conflicts in class, Court concluded that neither provision was satisfied. Rule 23(b)(3) states in part that the court [must] find that questions of law or fact common to members of class predominate over any questions affecting only individual members, and that a class action is superior to other available methods fair and efficient adjudication of controversy. In rejecting settling parties' position that these requirements were satisfied, Justice Ginsburg states that differences in amount and length of exposure, physical illness, medical history, causation and state law made it impossible to claim that predominance requirement had been met.
