Woodfin (Woodfin) was shot to death in his apartment by a police officer employed by the Knoxville Police Department (KPD).1 The events leading up to the shooting incident began about one month earlier, when Woodfin entered a Revco Discount Drug Store (Revco) in Knoxville, Tennessee, on May 4, 1997, and caused a considerable disruption. Revco's security guard, an off-duty KPD officer named Danny Boone (Boone), issued Woodfin a misdemeanor citation for disorderly conduct and warned Woodfin never to return to Revco.3 About one month later, Boone was again working as Revco's security guard when Revco's manager informed Boone that Woodfin violated his warning by entering Revco a few days earlier.4 When Boone called the KPD to inquire about the status of Woodfin's May 4 citation, learned that Woodfin failed to report to the jail for 'booking' on May 19 as ordered by the citation and that a bench warrant had been issued for Woodfin's arrest.5 Before going to Woodfin's apartment, Boone called four or five uniformed KPD officers to accompany him.6 Upon arrival, they discovered that Woodfin had locked himself inside the apartment and that would not allow anyone to enter.7 After obtaining a key to the apartment from a maintenance person, Boone and the officers entered the apartment to find that Woodfin had locked himself in the bathroom. Woodfin threatened that he had a shotgun pointed at the bathroom door and that would shoot anyone who entered.9 One of the officers kicked open the bathroom door and fired his weapon, wounding Woodfin in the stomach and ultimately causing his death. 10 The Plaintiffs IT filed a wrongful death suit for the shooting death of Woodfin by the KPD officers.12 The complaint alleged that the use of such deadly force by the officers against Woodfin was unreasonable and unnecessary to accomplish an arrest on a misdemeanor warrant.13 The Plaintiffs argued that Revco was liable for Boone's actions under the doctrine of respondeat superior because Boone acted `as an agent' for Revco, is According to the Plaintiffs, all times relevant to the action, Boone was working as a private security guard for Revco and ... was acting `under the direction, consent, control, and within the scope of his employment with Revco. `15 Revco filed a motion to dismiss the complaint, claiming that the [P]laintiffs failed to allege sufficient facts setting forth a cause of action because `Boone, as a matter of law, was acting solely within the scope of his duty as a police officer.16 Thus, Boone could not be considered an employee or agent of Revco. 17 After the trial court granted Revco's motion to dismiss, the Plaintiffs appealed to the court of appeals.18 The court of appeals adopted a test to examine the nature of the police officer's activities during the events leading up to the cause of action.19 Here, the appellate court determined that Boone's actions reflected 'a vindication of a public right,' thereby compelling the conclusion that Boone could only have been acting in his official capacity as a Knoxville police officer. …" @default.
