- W2597177639 abstract "This article raises and answers several important questions about Virginia’s method of appointing her judges: Why does Virginia use the appointment method? How is this method different from other states’ methods? Is Virginia’s judicial appointment process corrupt? And, perhaps most importantly: are reforms needed? The answers lie in understanding Virginia’s traditionalistic political culture, which emphasizes maintaining the status quo and government as the role for elites. Virginia has used the appointment method almost exclusively since her founding. A survey of historical and contemporary trends in Virginia’s judiciary reveals a low level of reported corruption of her judges, but a significant lack of transparency in the legislative selection and election of judicial candidates. The solution is not to switch to a different judicial selection method, because the benefits of other methods do not outweigh the benefits of the appointment method in the context of Virginia’s political culture. Rather, a more durable and comprehensive solution is to amend Virginia’s constitution to require the legislature to maintain a record of the judicial candidate vetting process in order to hold them accountable to their constituents for the integrity and impartiality (or lack thereof) of the judicial selection process." @default.
