• W2603933708 abstract "English Abstract: The privatization process of SOEs in Kosovo represents one of the most complicated pri-vatization processes in post-communist countries. It includes a number of distinctive fea-tures which have translated into a number of difficulties in the process that can be summa-rized in at least three main reasons: 1) Privatization process has been headed by a duality of institutions an international organization (United Nations Interim Administration Mission in Kosovo, UNMIK) and Kosovo Institutions; 2) Unclear legal base; and 3) Property right disputes. With the entry into force of the Constitution of the Republic of Kosovo since 15 June 2008, all laws passed by the Assembly of Kosovo which have amended the UNMIK Regulations, are the only valid laws. The same is true for the Law on the Privatization Agency of Koso-vo (PAK), approved in 2008, which replaced the UNMIK Regulation on Kosovo Trust Agency (KTA). Despite the new legal reality, the Special Chamber of the Supreme Court still considers the KTA Regulations as the law in force and does not recognize the Law passed by the Assembly of Kosovo on PAK. The denial of PAK as a fully legal entity and as a party in the court procedure is a breach of procedural regulations related to the rightful representation of a party in a civil law proce-dure, as well as a breach of constitutional rules related to a fair trial. It can be concluded that the Law on PAK although implemented correctly could not achieve the aim of abolish-ing the KTA. Hence, a new amendment of the existing privatization process is still neces-sary. German Abstract: Die Privatisierung von staatseigenen Unternehmen im Kosovo ist aus drei Grunden eines der schwierigsten Vorhaben dieser Art in den ehemals kommunistischen Landern: Zum einen wird der Privatisierungsprozess von zwei unterschiedlichen Einrichtungen geleitet – einer internationalen (United Nations Interim Administration Mission in Kosovo, UNMIK) und einer kosovarischen, des Weiteren bestehen Unsicherheiten, auf welcher rechtlichen Basis die Privatisierung gestutzt wird und schlieslich gibt es eine Vielzahl von eigentums-rechtlichen Auseinandersetzungen, die die Privatisierung erschweren. Seit dem Inkrafttreten der kosovarischen Verfassung am 15. Juni 2008 ist das Parlament der Republik Kosovo als Legislativorgan eingesetzt, sodass nur noch die von ihr verabschiede-ten Gesetze Gultigkeit besitzen. Davon ist auch das Privatisierungsrecht betroffen. Aller-dings wendet der oberste Gerichtshof weiterhin, die von der UNMIK verabschiedeten Re-gularien zur Einsetzung einer kosovarischen Treuhandanstalt (KTA) an und nicht das von der Legislative neu erlassen Gesetz zur Einsetzung der kosovarischen Privatisierungsagen-tur (PAK). Durch dieses Verhalten des Gerichtshofs werden nicht nur die prozessualen Rechte der neuen Rechtsperson PAK verletzt, sondern auch das verfassungsrechtliche Recht auf einen fairen Prozess missachtet. Damit wird deutlich, dass trotz der Implementie-rung des Gesetzes zur Ersetzung der KTA durch die PAK, Reformierungsbedarf besteht." @default.
