• W2604380748 abstract "תקציר בעברית: הנוגעת להסדר העדה הדתית במשפט הישראלי מספרת סיפור שגור, ולפיו בתקופה העות'מאנית פעלו בתי דין עדתיים, בעלי סמכות בענייני המעמד האישי, שדנו את בני העדות השונות על פי דינם האישי. על פי נרטיב זה הותיר המחוקק המנדטורי ה סדר זה על כנו, מתוך כוונה לשמור על ה סדר הקיים, ולאחריו ירשה את ההסדר השיטה המשפטית של מדינת ישראל, שבה היה ההסדר למאפיין מרכזי. מטרתו של מאמר זה היא העלאת טענה חלופית ולפיה רכיביו המרכזיים של ההסדר אינם מסורת עות'מאנית בת מאות בשנים, אלא שכלול חדיש יחסית של המחוקק המנדטורי, שבהליך של הבניה מודעת כמעט יוחס למקורות קדומים ומיתיים. במאמר אבחן בקצרה את ההיסטוריוגרפיה המקובלת הנוגעת להסדר, ואראה כי שלושת נדבכיה - קיומם של בתי דין דתיים נפרדים בעלי אוטונומיה נרחבת, הסמכות הייחודית שהוקנתה להם בעניינים שהם שיטה סדורה של מעמד אישי, ושמירת ההסדר על ידי הבריטים כחלק מרצון לשמר מצב קיים – אינם מובנים מאליהם, והם ראויים לבחינה מדוקדקת. מהמאמר עולה כי מצב הדומה למצב שיוצר ההסדר (הקיים בארץ ישראל ובמדינת ישראל במאה השנים האחרונות, מאז הכיבוש הבריטי) לא היה קיים בתקופה העות'מאנית. על פי החלופית שאני מציע, מקורו של ההסדר בשלטון הקולוניאלי הבריטי בהודו, ובבתי הדין הכנסייתיים שפעלו בבריטניה, עד לשנות השבעים של המאה התשע עשרה. בסיום המאמר אציג את הטיעון באשר להבניה המודעת של המיתוס ולפיו מקורו של הסדר העדה הדתית הוא עות'מאני, והנו חלק מהבניית הלאום היהודי בשנים המעצבות של התנועה הציונית, בטרם קום המדינה .ובסמוך לאחר מכן. English Abstract: The conventional historiography of the 'Religious Community Arrangement' in Israeli law tells a standard story, according to which in the period there operated religious courts, in which people of various persuasions settled their matters of 'personal status' according to their personal, religious law. According to this narrative, the British mandate legislators chose to preserve this arrangement, in order to maintain the existing social order. When the State of Israel was founded this arrangement has become a central feature of its legal system. The purpose of this article is to explore an alternative narrative claiming that the arrangement is not centuries old Ottoman tradition, but rather a relatively modern mechanism devised by the mandatory legislature, which in a process of conscious construction was attributed to almost mythical ancient origins. The article briefly examines the conventional historiography of the arrangement, showing that its three main tiers - the existence of religious courts with extensive autonomy, the courts' exclusive jurisdiction over a well-founded list of matters of 'personal status', and the keeping of the arrangement by the British as part of a desire to preserve existing social order - are not obvious, and deserve scrutiny. The article reveals that the state of affairs created by the arrangement, prevailing in British mandate Palestine and the State of Israel in the last century, did not exist during the period. According to the alternative narrative drafted in the article the roots of the arrangement can be traced to British colonial rule in India, and 'ecclesiastical courts' which operated in Britain until the mid-19th century. At the end of the article I will present the argument that the conscious construct of the myth of the arrangement's roots is a part of the Jewish nation building in the formative years of the Zionist movement before the founding of the state of Israel and in its first years." @default.
