Ainsi, un large eventails elements recurrents dans les controverses territoriales a ete passe au crible dans cette longue decision arbitrale, dont la contribution au droit de la delimitation territoriale est bienvenue. Dans cette perspective, la sentence arbitrale du 9 octobre 1998 peut etre consideree comme une application sur le terrain des outils, regles et concepts dont dispose le juriste de droit international. De la notion de titre juridique au principe de l'unite ou proximite geographique, en passant par la consolidation historique des titres territoriaux, le Tribunal arbitral a ete amene a passer au peigne fin les incontournables questions qui hantent tout internationaliste interesse au droit du contentieux territorial. Les solutions adoptees dans la sentence s'inscrivent, quant a elles, dans une certaine tradition en matiere de reglement juridictionnel des litiges territoriaux. C'est-a-dire celle ou une place non negligeable est reservee aux considerations d'equite et ou l'on privilegie par endroits une solution transactionnelle entre les revendications des Parties, en vue d'un reglement definitif du conflit territorial. En ce sens, la resolution de cette controverse territoriale represente un modele pour les nombreux differends territoriaux qui ternissent les relations interetatiques - et debouchent parfois sur des sanglants confits armes - dans cette region a la croisee de deux continents. English Abstract: The Eritrea - Yemen Arbitration Case (Phase I: Territorial Sovereignty and Scope of the Dispute) represented a unique chance of observing the concretisation of the concepts clearly elucidated by the President of the Tribunal, Sir Robert Jennings, in his authoritative work in this field. Indeed, a wide array of the recurring aspects in territorial disputes has been thoroughly investigated in this long arbitral award, whose contribution to the law of territorial litigation is highly welcome. In this regard, the arbitral award of October 9, 1998 can be considered as the concrete application of the rules, concepts and juridical tools which belong to the toolbox of an international lawyer. As a matter of fact, from the concept of legal title to the principle of natural and geographical unity, through the historical consolidation of titles, the Tribunals was led to analyse meticulously the unavoidable problems that haunt every international lawyer versed on the law of territorial disputes. The solutions adopted in this award fit into a well-established tradition of judicial settlement of territorial conflicts, That is to say, those judgments where the considerations of fairness and equity play a key role and where likewise a compromise (i.e. mutual -concessions adjustment) solution is adopted between the opposite claims of the Parties, in view of definitive settlement of the dispute. Actually, the peaceful settlement of territorial disputes through international adjudication might prevent a territorial crisis to become the prelude of a blood armed conflict. In fact, the settlement of the dispute between Eritrea and Yemen represents a model for all the other territorial conflicts that hamper interstate relations in this region (and a times degenerate into wars), which lies at the junction of two continents." @default.
