Yet despite this fact, during the second half of the nineteenth century children born out of wedlock were undoubtedly a reality in Transylvania. This phenomenon certainly varied according to the moment in time, location, nation, and confession. Certain specific causes can be shown to be responsible for these so-called “births from illegitimate beds.” One major factor was matrimonial legislation, which was restrictive for civilians, and yet more so for military personnel. It is generally admitted and has been demonstrated that economic factors—the cost of a wedding, the precarious financial condition of peasants—were decisive elements in the extent of birth out of wedlock. Migration, morals and traditions, and kinship relations are also possible reasons for illegitimate births. An explanation by way of sexual revolution does not apply in this case. This article is based on unpublished ecclesiastical and notarial sources. The legal status of children born out of wedlock was lower than that of legitimate children; however, the Austrian Civil Code granted certain succession rights to children born out of wedlock. Children born out of wedlock had the right to inherit their mother’s estate but not their father’s, unless the father had left a will to this effect." @default.
