IntroductionThe results of the activity carried out by the expert in order to settle the objectives brought up by the aspect examined are materialized in the survey report, which is forwarded to the Court of Justice or to the institution that disposed the survey performance.The survey report is a scientific document of a special evidence value. Taking into account its importance in settling a case, the survey report cannot be resumed to the simple exposure of the conclusions to which the expert reached, but it also has to reflect in a concise but complete manner the stages of the path covered by the expert until the final conclusion.2. The Survey Report' FormTo this purpose, the survey report must mainly contain the following:1- the introductory part, in which it is mentioned the institution that disposed the survey performance, the date when the survey was disposed, the last name and first name of the expert or specialist, his/her field of activity, the date when the survey report was drafted, the object of the survey report and the questions addressed to the expert or specialist, the procedure related to the survey and mentions regarding the possible explanations given by the parties' representatives during the survey;- description of the operations and activities performed on the occasion of the survey, the parties' objections or explanations, as well as their analysis or interpretation based upon the ascertainments of the expert or specialist;- the conclusions of the survey, respectively the expert's answers to the questions addressed as well as his/her opinion regarding the survey objective.The survey report drafting must be made in compliance with other procedural rules, in terms of their form and contents.The form of the survey report may be oral or written, according to the place where the survey is carried out (in front of the related institution or outside it), as well as to the nature and specificity of the problem in litigation.In all cases where the survey related works require time, transports, documentations, researches, analyses, tests or laboratory tests, etc., the survey report is submitted in writing.Among the main procedural rules regarding the survey report, we shall mention the following: the necessity of its typewriting in many counterparts, of which two are submitted to the record office pertaining to the Court of Justice.The survey report is signed at the end, and each page must bear the stamp of the expert. The signature and the stamp are affixed on both the original documents as well as on their related counterparts, as this procedure is necessary to avoid the substitution of some pages.The survey report shall admit no mistakes, corrections or erasures.The survey report must be submitted in due time; as a rule, the submission is made at least five days before the date when the related litigation is to be judged.The submission date for the survey report is settled by the Court of Justice or mentioned in a written power of attorney handed in personally to the expert (especially in case of those surveys initiated by the administrative institutions).Unreasonably grounded noncompliance with the term fixed for the survey report submission may lead to material and even criminal sanctions.The survey report is submitted as a document composed of many pages, grouped in sanctions. …" @default.
