The material is high BTU, relatively clean material, oftentimes classified as hazardous merely because it's ignitable. So that's a controversial issue and one that's been going on for about a decade. And it's not over yet. The other one is this whole aspect of how do you create incentives for compliance as opposed to the command and control approach. feel that environmental law has matured to the point that we are not dealing with the regulated community mentalities of the fifties, sixties, and seventies. don't think the law has yet caught up with the realities of today, and so those are the two most challenging areas. NR&E: Any thoughts on how to build in incentives for compliance? Golemon: think those who manage their compliance and who attempt to have really aggressive programs to stay in compliance should be treated differently than those who don't. Unfortunately, they are being treated differently today in the wrong way . . . because those who really manage their compliance when they come in and voluntarily disclose are being penalized. They say, I made a mistakethey're the ones who are the first to be prosecuted as opposed to government saying, all right we will put you on a timeline for certain kinds of improved performance standards with no penalties. The person who never comes into the system too often escapes because there is no way that the government is going to be able to enforce as well as an aggressive program conducted by municipalities or a corporation that knows its business best. We have a dysfunctional enforcement system. There is a large segment of the regulated community trying to comply with environmental regulations. How you bring around the shift in the incentives for those that are monitoring their compliance status is, think, to provide penalty immunities and then, in some instances, be able to limit the use of the documents that they disclose to the government when they report fail-" @default.
