WACHTELL: Thank you. luncheon speaker, Morton Halperin, referred to the FOIA as essentially representing a revolution. And I think, in a way, this was a very apt description. In all of the discussions that we have about procedures, demands, ten days, stopping disclosure, and the like, it is something that we really should not lose sight of. It is probably a provision which is unique in the world, a declaration by a government saying: Our records are open. To a great extent, then, anybody can come along any member of the general public, even if acting out of mere curiosity and find out what is going on and get documents and files. It is a commitment to a very fundamental sort of responsible democracy. Having said that, we must note that the FOIA is not without its problems: to business, to corporations, or frankly, to any of us. Because when you focus upon what is sitting in government files, the materials there are not only materials that government employees are generating. In the complex and allpervasive type of government that we have, government files are also a repository of an incredible wealth and variety of materials that have been submitted to the government by third persons often, but not always, corporate enterprises. Such submissions are sometimes made voluntarily, sometimes quasi-voluntarily (as the price of doing business or the price of getting a government contract, e.g., a bid), and sometimes under compulsion (you receive a formal SEC subpoena, or a request for information or testimony in the course of an informal SEC investigation). We have had a lot of examples of this kind of thing this morning but to my mind to give examples is to dramatize the breadth of the problem:" @default.
