- W2749207923 abstract "With arbitration becoming a common way of solving international commercial disputes, issues not considered capable of being arbitrated are diminishing. Arbitrators are therefore not prohibited from applying various mandatory rules, including European competition law, to a certain extent. When concluding an agreement, parties must have regard to competition law issues to make sure that the agreement is not contrary to those principles. These two different legal fields are therefore bound to intersect. Competition law experts have held that arbitration could be a threat to effective competition law enforcement. On the opposite, arbitration experts have argued that competition law can pose a threat to well established principles of arbitration, the finality of arbitral awards and the principle of party autonomy.The Court of Justice of the European Union has stated that Articles 101 and 102 of the Treaty on the Functioning of the European Union cannot be derogated from and are a matter of public policy. In the light of the mandatory nature of these provisions, it raises the question whether arbitrators are under a duty to apply them on their own motion, even if it would oblige them to abandon the passive role assigned to them. Additionally, this discussion leads to the question whether national courts review arbitral awards on the merits, in order to ensure the proper application of European competition law.It can be argued that arbitrators should only apply European competition law ex officio when such violations are obvious. However, because of the complexity of European competition law, violations are seldom obvious. Furthermore, national courts rarely refuse enforcement of arbitral awards on the grounds of public policy, which supports the view that arbitrators should not apply European competition law ex officio, if it would oblige them to abandon the passive role assigned to them.; Gerðardomsmeðferð er orðin hefðbundin leið til þess að leysa deilur sem risa i tengslum við alþjoðlega viðskiptasamninga.
