Ayers, 123 S.Ct. 1210, the U.S. Supreme Court held, part, that workers suffering from asbestosis resulting from work-related exposure to asbestos may recover damages for fear of future cancer as of pain and suffering. Six former employees of the Norfolk & Western who suffer from asbestosis brought suit under the Federal Employers' Liability Act (FELA), 45 U.S.C. [subsections] 51-60, which imposes liability on common carrier railroads for work-related injuries caused in whole or part by the railroad's negligence. The plaintiffs alleged that the NW Consolidated Rail Corp. v. Gottshall, 512 U.S. 532 (1994). Recovery for the first type of NIED claim is limited by the zone-of-danger test, which confines recovery to plaintiffs who, the Court stated, (1) sustain a physical impact as a result of a defendant's negligent conduct; or (2) are placed immediate risk of physical harm by that conduct--that is, those who escaped instant physical harm, but were within the zone of danger of physical impact. The Court determined that the plaintiffs' claims the case before it were of the second type that is, claims resulting from asbestosis (a physical injury) for which pain and suffering were recoverable, here, the fear of cancer. The Court rejected N&W's contention that the plaintiffs' alleged cancer fears were too remote from their asbestosis to warrant inclusion the awards for pain and suffering. N&W relied on the so-called separate disease rule, under which the statute of limitations runs separately for each asbestos-related disease, thus allowing asbestosis plaintiffs to bring a second action if they become ill with cancer. …" @default.
