• W2771036803 abstract "본 연구에서는 구강청정제를 사용한 후 경찰의 음주단속에 적발되었던 A교수의 사례를 제시하고, 이를 일반화 할 수 있는지에 관한 실험을 실시하였다. 2차에 걸쳐 실시된 실험결과는 다음과 같이 요약할 수 있다. 제1차 실험에서는 만약 단속경찰관이 「교통단속처리지침」과 판례에서 제시한 바와 같이 알코올 소거시간 20분을 준수하고, 피단속자에게 입을 헹굴 기회를 제공하였다면 구강청정제 사용으로 인한 과대측정의 가능성은 없다는 잠정적인 결론을 내릴 수 있었다. 제2차 실험에서는 ①구강청정제 사용직후에는 구강 내 잔류알코올로 인해서 혈중알코올농도가 0.14%에서 0.4%까지 과대측정될 수 있고, ②구강청정제 사용 후 10분이 경과되었을 경우에도 0.2%까지 과대측정될 수 있지만, ③200㎖ 상당의 미온수로 입을 헹궜을 경우에는 과대측정의 가능성이 없어졌고, ④A교수의 사례는 일반화하기는 어렵다는 결론에 도달했다. 하지만 경찰관리자들은 ①음주단속절차를 비공개 경찰청 내부지침에 규정하고 있다는 사실은 법치행정의 원칙에 반할 소지가 크고, ②호흡측정방식은 적지 않은 오차를 지닐 수 있으며, ③혈액검사를 우선하고 음주측정불응죄를 폐지하는 방향으로의 제도개선이 필요하고, ④음주측정 결과가 정확성과 객관성이 담보될 수 있는 공정한 방법과 절차에 따라 이루어진 것이 아니라면 유죄의 증거로 사용할 수 없다는 등의 학계와 법원의 지적에 주목하여야 한다. 그리고 먼저 실증연구를 통해서 일반 시민들이 전적으로 공감할 수 있는 음주단속기준과 절차를 도출하고, 다음으로 이와 같은 기준과 절차가 최소한의 법규성을 확보할 수 있도록 노력하여야 할 것이다.The purpose of this research is to investigate the current laws and policies on responding DUI(driving under the influence of alcohol) and to analyze the residual mouth alcohol of the users of alcoholic or nonalcoholic mouthwash. According to the Korean Road Traffic Act, when deemed necessary to ensure the safety of traffic and prevent danger and anyone is evidently deemed to be DUI, police officers may require him/her to take a breath test in order to determine whether that person is intoxicated(Road Traffic Act §44②). And in Korea, the statutory limit for blood alcohol concentration adopted is 0.05%(Road Traffic Act §44④). Further more, when a driver of any motor vehicle, etc. is deemed to be DUI, police officers may order the driver of the motor vehicle, etc. to stop driving the motor vehicle, etc. until the point at which he/she is able to drive normally the motor vehicle, etc. and take other necessary measures against the driver(Road Traffic Act §47②). But a number of scholars and stakeholders have criticised that alcohol breath test(ABT) may have error range because of residual alcohol in the mouth and current procedure is may be contrary to principle of the due process of law. The following items can be suggested as solutions and alternatives for the issues. First, it is necessary to adopt blood test frist principle and it should be kept strictly 20 minutes deprivation period. Second, it is needed to abolish the penalty on the sobriety test disobedience. The outcomes of these experiments suggest that residual alcohol in the mouth due to alcoholic mouthwash will be disappeared after 10 minutes elapsing and by way of rinsing his or her mouth with fresh water." @default.
