This quotation understates the complexity of the English approach to contaminated land that is his subject. In total, 114 of the book's 172 pages are devoted to copies of the three documents that comprise the framework for the new contaminated land policy. Only one of these, Part IIA of the Environmental Protection Act 1990 (EPA), is formally legislation. The other two are the Contaminated Land (England) Regulations 2000 (CL(E)R) and the subsequent Guidance Notes, providing instruction on implementation of the regulations, issued as a Department of Environment, Trade and the Regions (DETR) Circular on Contaminated Land (Guidance), Annexes 3, 5 and 6 of which are provided in the book.1 The final layer of the complex policy should be in place as this review is published: the fifteen months allowed for local authorities to develop their strategic approach to contaminated land will have passed. Trevor Hellawell makes very clear just how di cult the development of these strategies will be, through careful citation from the underlying legal requirements-which justifies their duplication in the volume. He offers brief, but exceptionally cogent, discussions of the overlapping jurisdictional issues, contradictory guidances and requirements, and related problems evident in the regime, even prior to adoption of local authority strategic plans. For example, the author clarifies the problems inherent in a definition of 'contaminated land' that can result in a site having to be redefined and classified even in the absence of any new works or land uses on the property. With a definition of contamination tied to 'significant harm' unless pollution of 'controlled waters' is involved, new discoveries about possible harm, or modifications to the waters subject to control, can clearly bring new sites into the ranks of the contaminated with no change of the conditions on the properties. Useful warnings of a problem for local authorities, unlike any evident in earlier and other nations' approaches to contaminated land (Meyer et al., 1995). The chapters provide an excellent outline for an understanding of the logic and processes of the new contaminated land regime. It begins with a definition of contaminated land, and the author links the new legislation of other regimes, noting overlapping and ambiguities in key areas.
