• W2803705802 abstract "תקציר בעברית: מאמר זה עוסק בסוגיית היחס בין המשפט הבינלאומי והמשפט החוקתי בישראל ובשאלה האם יש להחיל את הכללים החלים כיום בישראל בנוגע ליחס בין המשפט הבינלאומי למשפט הישראלי (כללי הקליטה) על חוקי היסוד במדינת ישראל. המאמר מתמקד במשפט הבינלאומי של זכויות האדם, וביחס בין משפט זה לבין חוק יסוד: כבוד האדם וחירותו וחוק יסוד: חופש העיסוק. נקודת המוצא לדיון הינם כללי הקליטה המקובלים כיום, הקובעים כי המשפט בינלאומי המנהגי מהווה חלק מהדין הפנימי בישראל, אך חקיקה ראשית הסותרת אותו גוברת עליו, וכי אמנות אינן מהוות חלק מהדין הפנימי אולם חלה לגביהן חזקת התאמה פרשנית, הקובעת כי יש לפרש את הדין הישראלי, ככל הניתן, באופן העולה בקנה אחד עם אמנות בינלאומיות אשר המדינה הינה צד להן.המחלוקת בשאלת היחס הראוי בין המשפט הבינלאומי למשפט החוקתי המדינתי אינה יחודית לישראל, והעמדות השונות בה כרוכות, כפי שידון במאמר, בתפיסות יסוד שונות ביחס למהותה של ריבונות המדינה ולמהות המשפט הבינלאומי בכללו. החיכוך בין המערכות המשפטיות השונות מתמקד, פעמים רבות, בתחום זכויות האדם, הן בשל העובדה שבתחום זה החפיפה בין תחומי העיסוק של המשפט הבינלאומי והמשפט המדינתי הינה הרחבה ביותר, והן בשל העובדה שמשפט זכויות האדם, במירב המקרים, מטיל על המדינה חובות אשר ביצוען נדרש לא בזירה הבינלאומית אלא במדינה עצמה.נקודת המוצא של המאמר הינם כללי הקליטה החלים כיום בישראל. המאמר אינו מבקש לשרטט את כללי הקליטה האופטימליים אלא בוחן את ההצדקות לכללים הקיימים, ואת השאלה האם, לאור הצדקות אלה, יש להחיל את כללי הקליטה גם על חוקי היסוד. המאמר טוען כי התשובה חיובית, הן משום שההצדקות לכללי הקליטה הקיימים תקפות גם בקשר לחוקי היסוד, הן מטעמים של קוהרנטיות משפטית והן בשל התוצאות הקשות של אי החלת הכללים. המאמר טוען, לפיכך, כי משפט זכויות האדם המנהגי ממשיך לחול בישראל גם לאחר חקיקת חוקי היסוד, וכי יש להחיל את חזקת ההתאמה הפרשנית על חוקי היסוד. English Abstract: This article examines the relationship between international law and constitutional law in Israel and the application of the existing roles of incorporation to Israel’s Basic Laws. The article concentrates on the international law of human rights and its relationship with Basic Law: Human Dignity and Liberty, and on the role international law should play in constitutional interpretation in Israel.Under Israel’s domestic law, customary international law is part of the “law of the land”, yet it is superseded by explicitly conflicting Knesset legislation. Treaties, on the other hand, only become part of Israel’s domestic law once they are incorporated through legislation. In numerous cases, the Supreme Court reaffirmed that laws should be interpreted, where possible, in a manner that is consistent with Israel’s international obligation. The “presumption of compatibility” has been applied both with regard to customary law and with regard to treaties.The applicability of these rules to Israel’s Basic Laws has yet to be determined by the Court. The question was recently brought up in HCJ 8425/13, Eitan v. the Government of Israel, which concerned the constitutionality of a law permitting the detention of asylum seekers. While the petitioners argued that the Basic Laws should be interpreted in a manner consistent with international law, the respondents argued that such a rule is incompatible with the existing hierarchy of norms in Israel. The Court refrained from explicitly ruling on the matter.The article argues that the presumption of compatibility should be applied to the Basic Laws. It argues that such application is warranted in order to maintain legal coherence and to prevent a deterioration in the status of human rights in Israel. It also argues that, contrary to the claims made by the respondents in Eitan, such application does not violate Israel’s sovereignty and it compatible with the notion of sovereignty under to which the rules of incorporation were originally adopted." @default.
