In forecasting the future forty years, it begins with the historical background of the past forty years of the international, or transnational, legal system. Key to its forecasting is the steady growth of international law in its administrative mode.The article breaks down the administrative functions of international law, beginning with the formal structure of international law. Despite strict limitations on the formal structure of international legal authority, reluctance of governments to expand that authority, and the shallowness of the traditional regime of international administrative law, the actual scope of administrative authority has expanded greatly at both domestic and international levels. Then, the article discusses a proposed new model of domestic administrative law, based on comparative insights. This model, the article argues, is a more realistic portrayal of the role of administrative law in the international legal system, encourages the best practices of international law in its administrative mode, and would broaden our understanding and use of international law in its administrative mode.Next, the article examines the relationship between nongovernmental organizations (NGOs) and international law in its administrative mode. Pointing to NGOs’ uncertain legal status and well founded skepticism thereof, the article argues that the administrative regime should be selective and based on an independent analysis of each NGO, rather than integrating all NGOs into a workable system of international administrative law. The article suggests that a trend expected to continue during the next forty years is toward a litmus of accountability to define the status of NGOs with the international legal system.The article concludes that the future-looking trends mean that international law in its administrative mode must take myriad administrative practices into account. A new model of administrative law based on accountability can more readily embrace these needs. Such a model will substantially expand the horizons, excite the imaginations, and tax the skills of international lawyers during the next forty years." @default.
