Marrying technology with law multiplies opportunities and concerns, particularly to vulnerable populations like people with chronic pain. Pain figures prominently in many legal domains, including whether a person receives state benefits or private compensation, or has sufficient consciousness to experience pain, or even how much pain the state can inflict lawfully. Increasingly, brain-based imaging offers access to the brain in pain. Thus, in pain, there is a nexus of new technologies, significant legal issues, and a vulnerable population. What should law make of this nexus? A threshold issue is accuracy: Brain-based chronic pain imaging is not currently reliable enough to determine individual pain. Solving for accuracy will not solve most legal issues. However, degrees of monitoring, measurement, and evidentiary burden imposed by law tend to track a group's social status rather than its empirical risk. These burdens produce systemic costs while reinforcing the low status of the group, a double negative. Currently, people alleging chronic pain are put to disproportionate burden; imaging-based vouching would be undermining and inaccurate. Pain imaging could be constructive if it underwrites new acceptance chronic pain disorders, leading to more accurate legal doctrines and practices, and is employed to benefit the subject, as in patients with disorders of consciousness. This article also looks at certain legal and ethical issues across uses of brain imaging, including accuracy, access, and the importance of the individual as the authority to his or her own inner state." @default.
