- W2896064156 abstract "This chapter discusses to what extent and how the EuropeanCourt of Human Rights (ECtHR) has engaged in domestic judicialdesign. It shows that the judgments of the Strasbourg Court,rather than having effects only with respect to the individualwhose rights have been violated, has much deeper structuraleffects in the design and operation of domestic judicialsystems. This chapter argues that this phenomenon goes ratherunnoticed, but it has deep implications for both the developingand developed democracies. To demonstrate this phenomenon, thechapter assesses the impact of the ECtHR on three judicialdesign issues. First, it illustrates how the ECtHR haschallenged the role of the advocates general. Second, itexplains how the ECtHR has gradually curbed the jurisdiction ofmilitary courts over both civilians and military officers,which has brought these courts to the brink of their abolition.Finally, it outlines how the ECtHR in its judgments regardingthe disciplining of judges empowers the judiciary at theexpense of other political institutions within the State. Basedon the analysis of these three judicial design issues, itconcludes that the Strasbourg Court is affecting the internalarchitecture of domestic judiciaries as it gradually endorsesthe unification of court administration and changes the powerstructures within the judiciary. Interestingly, neither theestablished democracies nor the developing countries have shownsignificant resistance to these far-reaching requirements thatimpinge upon the cornerstones of domestic judicial systems.This chapter proposes possible explanations of why this is soand identifies avenues for further research." @default.
