- W289784976 abstract "PERHAPS THE BEST and simplest way to begin talking about the state of American legal history is to report that it is booming. The field is finally coming into its own. A generation ago, it was taught at a handful of schools-in 1950 probably two or three law schools at most, and probably no history departments at all. The field, practically speaking, did not exist. I would not be surprised to find that more than 95% of the significant work in American legal history has been done in the last twenty years or so. Of course, there had been research and writing about American legal history before 1950, too. That year, however, was a kind of turning point. For convenience, we will divide the history of the field into three periods-knowing full well, as is always the case, that there is a good deal of oversimplification, messiness, and even rank injustice in so doing. The first period is the period before 1950, the period of doctrinal history. This kind of history flourished best in England, with regard to English legal history, but it had outstanding representatives in this country too. The stress was on the history of doctrines, how they began, how they developed, how they grew. The work concentrated on the common-law, and the focus was on concepts, rules, purely internal legal materials. This was technical, competent, lawyerly history. There was a great deal of interest in origins, in how this or that rule started and grew; there was very little attention to socio-economic context. Some of the work was dry and arid. Some was not. The legal system, in this mode of writing, was treated as largely autonomous: as an entity in itself. This was history on the model of" @default.
