- W2909355663 abstract "At the turn of the twentieth century, private property became a focus in two overlapping but separate areas of American law: marital property reform and the right to privacy. Feminists fought to allow women the right to control their separate property ownership in marriage, and legal scholars fought to establish a “right to privacy” by relying on the language of property ownership, such as the property of the private home. This paper examines the intersections of these areas of laws by considering the language of privacy and private property in Edith Wharton’s Summer and legal cases that interpreted reforms in marital property rights. Summer’s central character, Charity Royall, seeks privacy rights not afforded to women during this time period, such as the right to private-decision making and the right to privately held property in marriage." @default.
