- W2915292727 abstract "This paper is the first in a set of three. The purpose of it is to demonstrate how reliance by legal institutions on gender stereotypes and preconceptions has affected the economic status of women. The paper questions fundamental principles of jurisprudence. The analysis in this paper provides a framework for the formulation of questions aimed at detecting gender bias in laws. The paper argues that gender bias in its various forms is often hard to detect because it is so embedded in our institutions. Natural law and custom are identified as major philosophies which form the basis for gender differentiations in laws. The historical test used to verify the notion of male superiority over female is the perceived superior fighting strength of men. However, this is contradicted by early non-western societies in parts of Africa and Asia where women were known to be the best fighters and served as warriors. Many customs which differentiate on the basis of sex build on the natural law male superiority position to assert female frailty and female domesticity. These assertions lead to customs which establish man's domain in the public sphere of life performing functions which require skill, strength, and mental capacity; woman's domain is the private sphere of life where functions related to the family and home are found. The paper illustrates that in many instances this role division has led to the development of laws which cannot be applied logically and consistently." @default.
