The western United States is defined by aridity, which refers to the basic lack of rainfall between the Mississippi River and the Sierra Nevada Mountains. Rainfall in this region is, on average, less than the twenty inches per year needed to farm without irrigation. To support economic development, the federal government and the western states developed laws on allocation of water that protected early investment and subsidized development of water infrastructure to cultivate the desert only to find that the demands for water, and the amount of water available, would change dramatically. Growing urban demand, increased understanding of habitat needs, and increasing frequency of drought place considerable tension on the inflexible legal institutions governing water in the West. Jurisdictional boundaries split basins, guaranteeing that no one governmental entity can solve the problem. Into this mix are thrown the unquantified, undeveloped, and generally senior water rights of the Native American tribes. Surprisingly, the need to allocate water to the undeveloped rights of the tribes is seen by many as an opportunity. For some living near a reservation, the prospect of a large senior water right in a basin presents the opportunity to purchase water for growing demands. For others, development of tribal water presents the opportunity for long overdue rehabilitation of existing water infrastructure to serve both on-reservation and off-reservation agriculture. All this interest can be a boon to long-neglected needs for tribal economic and resource development or habitat restoration. What should not be missed in the rush to capitalize on local opportunity, is the chance to introduce some flexibility into the West's archaic means of water allocation flexibility to repair ecological harm, to provide a more equitable sharing of the resource, and to create the institutions necessary to respond to future changes in supply and demand for the basin as a whole. Failure to do so jeopardizes the durability of the solutions achieved through settlement.
