Previous histories of the 1825 Antelope Supreme Court case (The Antelope, 23 U.S. 66), notably John T. Noonan Jr.'s 1977 work, are no exception to this pattern. To be sure, the Antelope's story is a messy one, but anachronizing antipathy to enslavement does little to aid our understanding of the significance of this case. Jonathan M. Bryant's new take on this all-too-often marginalized case is an important departure from the moralizing that has prevailed. The U.S. Revenue Service captured the Antelope in 1820 off the coast of Spanish Florida with more than 280 enslaved Africans aboard. Under various names the ship had been engaged in the slave trade when a privateer seized it at the mouth of the Congo River. The U.S. legal case, focused on the enslaved or free status of the captured Africans, wound its way through U.S. courts for seven years. In 1825 Chief Justice John Marshall declared that while the international slave trade may be against the law of nature, the actions of the privateers did not constitute piracy nor could they be considered contrary to international law. The court's Solomonic decision—presaging many more slave-related decisions over the next several decades—found only a minority of the captured Africans to be legally enslaved, dispatching the remaining 120 Africans who had survived to Liberia, where they established New Georgia." @default.
