There were major disputes within the academic community, and, despite negative votes from four out of five college faculties and from the University Senate, the reorganization plan was approved by the board. AAUP took no position on the plan and did not intercede in senate or other collegial deliberations on the matter. AAUP has, however, declared its collective-bargaining rights in regard to protecting terms and conditions of faculty employment under the new plan. This instance illustrates the relative weakness of the faculty governance structures at Rutgers and it also shows the demarcation point between senate business and bargaining business. These illustrations indicate that, although there are points of contention and dispute, there has been a basically cooperative relationship between the University Senate and AAUP as a bargaining agent. The perceived threat to faculty governance has not developed as a direct result of collective bargaining; rather, I think, faculty governance has not been strong as a result of factors other than bargaining and, if anything, bargaining has assisted and supported faculty governance structures at the university. Our experience or my interpretation of it may be unusual, but more recent literature is congruent and suggests that academic bargaining may be responsible, not for eroding faculty power, but for demonstrating how weak it is in some institutions. My position is not that the faculty necessarily make wiser or better academic decisions, but that they make more legitimate ones if higher education expects to be a collegial enterprise.
