- W2968757912 abstract "Our aim is to add practitioners’ perspectives but, in writing this chapter, we were informed by the practice guidance available in both New Zealand and England and Wales (since Julia Hennessy has considerable experience of and expertise in both jurisdictions). These are, respectively, Restorative Justice in New Zealand: Best Practice (Ministry of Justice 2004) and the Best Practice Guidance for Restorative Justice Practice (Restorative Justice Council 2011). Both sets of guidelines refer to family violence, but it is suggested in the New Zealand document that restorative justice processes should only being undertaken ‘in appropriate cases’ and family violence is referred to as ‘sensitive and complex’ in the England and Wales document. Both place a high priority on the specialized skills level and knowledge of facilitators, safety and participants’ fully informed consent before participating in a restorative justice process. There are some slight differences in emphasis, however. Although both documents refer to risk assessment processes, the later England and Wales guidelines formalize this by including them in its guidelines (Restorative Justice Council 2011). The England and Wales document also cites the importance of continuity in the handling of cases by the facilitators whereas the New Zealand document states that participants may require some form of follow-up after the conference (Ministry of Justice 2004: 17). The England and Wales document (Restorative Justice Council 2011) also specifies compliance withchild protection legislation and regulations whereas the New Zealand document refers specifically to restorative justice not being a substitute for the criminal justice system (Ministry of Justice 2004: 27).
