- W2980451370 abstract "Dementia may be a significant risk factor for elder abuse (Dong, 2014). In 1997, California enacted Penal Code 368 with special protections for elderly and dependent adults. But deficiencies in local law enforcement policies hindered implementation of those special protections. Media coverage emphasized a lack of law enforcement protection for residents in long term care. San Jose Police Department (SJPD), the nation's tenth largest police force, determined a flawed abuse policy was a root cause of officers disregarding crimes against elderly victims. In 2015, SJPD developed California's most proactive written policy to protect elderly victims of crime. From 2015 to 2018, enforcement increased six-fold. SJPD encouraged California's legislature to develop similar policy statewide. In 2018, written abuse policies for 95% of California's local law enforcement agencies lacked appropriate guidance on elder abuse. One southern California county has an abuse policy from 1987, ten years prior to Penal Code 368. A neighboring county has no policy on elder abuse reports from the public. A city in northern California has a policy of not accepting elder abuse reports. Statewide systems change is needed. California Senate Bill 1191 (2018, Hueso) set the stage for statewide policy and systems change. The bill requires revised law enforcement policies to incorporate language from California's Department of Justice and from Penal Code 368. Revised policies inform long-term care leadership that elder abuse is a crime under California law. Revised policies inform law enforcement that they have exclusive responsibility to investigate crimes against the elderly. Senate Bill 1191 could drive statewide systems change in law enforcement response to elder abuse. Research hypothesis: Improved law enforcement policy will drive increased enforcement of elder abuse laws, resulting in greater protections for persons with dementia." @default.
