For Duncan Kennedy, the law is indeterminate in the sense that it is always possible ‘to destabilize initial apprehensions’ about it through the activity of interpretation. The purpose of this article is to suggest that Raz’s account of interpretation can give independent support for Kennedy’s indeterminacy thesis. In particular, I consider here three theses in Raz’s account of legal interpretation. The first thesis is that the resources available to an interpreter of the law cannot (and need not) be generalised into a theory of interpretation. The second thesis is that there is no general requirement that legal standards need to be made coherent by a sufficiently resourceful interpreter. The third thesis, a redux of the first, is that how we ought to interpret the law is informed by four foci points of interpretation (the authority of the law, the continuity of the law, the development of the law, and equity). I then argue that this account of legal interpretation is amenable to Kennedy’s indeterminacy claim. Kennedy holds that the resources available to a legal interpreter are in inevitable conflict and since there are no higher-order concepts that are able to resolve this conflict. He therefore suggests that the activity of interpretation is always able to destabilise the law, rendering the law indeterminate (even where we initially apprehend it as determinate).
