- W3121837112 abstract "This article presents the content of the statutes of the 50 states (and the District of Columbia, Puerto Rico, and Virgin Islands) in reference to wrongful death suits and damage awards. The information displayed herein was gathered from The Martindale-Hubbell Law Digest (1995) and the American Tort Reform Association Informational Newsletter (June 30, 1995). We identify 25 distinguishable kinds of awards, limitations, and procedures in the various states, suggesting a tabular presentation. The presentation is comprehensive and to our knowledge constitutes the first tabular summary of state statutory law on the subject of wrongful death. The survey results and the format of presentation should be of interest to both academic economists contemplating comparative institutional analysis as well as practitioners who are engaged professionally in multiple jurisdictions. Our procedure was to place an entry in a category only when the statutes of that state explicitly mentioned the procedure to be followed in the specific regard. Items not explicitly stated in the statutes would be governed by common-law precedents which would have to be researched separately on a state-by-state basis. Items i through 8 address the issue of which damages are recoverable in wrongful death actions. Entries describe whether or not statutes provide for various types of damages (e.g. hedonic, punitive, economic, compensatory noneconomic) or recovery of loss of consortium or future earnings. Also entered are procedural stipulations indicating whether the statutes yield to common law in the matter of compensatory damages and the time frame in which a suit seeking damages must be filed. Items 9 through 17 list various limitations on recoverable damages. Limits can exist on the total award or the punitive, economic, or noneconomic components. There can also be limits to recovery of loss of consortium or future earnings. Also noted is whether all, some, or none of the recoverable noneconomic elements are specified in the statutes. Items 18 through 25 describe the attributes of award calculation. Covered are such matters as whether the expense of the action itself is subtracted from the award; whether the decedent’s illness and funeral expenses or the cost of administering decedent’s estate get subtracted from the award; whether there is surviving spousal support provided; and whether awards are reduced for reasons of transfer or succession taxes, claims against decedent’s estate, or personal consumption of the decedent. Our findings display various avenues being traveled in the pursuit of tort reform in contemporary society.
