- W3124033977 abstract "The FTCA enables individuals to bring an action grounded in tort against the U.S. government in the U.S. District Court. The Tucker Act enables individuals to bring an action grounded in contract against the U.S. These two kinds of actions intersect when the U.S. allegedly breaches a contractual duty, and as a result a third party is physically injured. Ostensibly, such an action is a tort and should be litigated under the FTCA and in the U.S. District Court. However, a long standing policy providing that a government contract be interpreted and applied using federal law complicates the matter. This is so because, under the FTCA, state law applies. Thus, if a negligence action based on the breach of a contractual duty embodied in a government contract were litigated in the District Court under the FTCA, state law would apply and the long standing policy previously mentioned would be violated. For this reason, the court in Woodbury v. United States, 313 F.2d 291 (9th Cir. 1963) held that such claims were in substance breach of contract claims for jurisdictional purposes. The court in Martin v. United States, 649 F.2d 701 (9th Cir. 1981) later distorted the Woodbury opinion by holding that such claims were only in substance breach of contract claims when the tort resulted in pecuniary harm. However, the Woodbury opinion did not limit its holding in such a manner. The Ninth and Third Circuits have expressly adopted the limit in Martin. The Eleventh Circuit has adopted Woodbury without commenting on Martin. This article advocates the rejection of Martin by the Eleventh Circuit and upholding the reasoning in Woodbury and Blanchard v. St. Paul Fire & Marine Insurance Co., 341 F.2d 351 (5th Cir. 1965)." @default.
