Der einfache Seemann arbeitet zu dieser Zeit unter widrigsten Bedingungen in den Kesselräumen der Dampfschiffe. Rund 60 Jahre später – Motorschiffe haben Dampfschiffe inzwischen abgelöst – ordnet der deutsche Gesetzgeber die weitgehende Angleichung von See- und Landarbeitsverhältnis an. Weitere 60 Jahre später wird in Reaktion auf die Globalisierung der Seeschifffahrt mit der Maritime Labour Convention (MLC) eine »Bill Of Rights« für das weltweite Seearbeitsrecht geschaffen. Das Seearbeitsgesetz aus dem Jahr 2013 steht – allzu passend zum Regelungsgegenstand – am Ende dieser langen gesetzgeberischen Reise. Die Arbeit enthält eine umfassende Bestandsaufnahme des Seearbeitsrechts im Jahr 2020. Sie zeichnet zunächst die bewegte Geschichte des Seearbeitsverhältnisses nach und erläutert dann handbuchartig die wichtigsten praktischen Fragen des Seearbeitsgesetzes. Diese reichen vom persönlichen Anwendungsbereich des Gesetzes, über den Vertragsschluss und die Besonderheiten der Offshore-Arbeit, bis hin zur Hafenstaatkontrolle. Die Arbeit zeigt praxisnah auf, wie die – größtenteils historisch gewachsenen – Vorschriften des Seearbeitsgesetzes vor dem Hintergrund der internationalen Vorgaben und des nationalen Gebots der Angleichung an das Landarbeitsrecht auszulegen sind." @default.
