Fifty years ago the Vinerian Professor of English Law at Oxford was seen as the expert on most matters relating to Victorian Britain. The Law of the Constitution was not only the textbook for the specialist but also required reading for the educated. Whether one was seeking a professional career in law or administration or a political post at Whitehall or in Parliament, the lectures, delivered first in 1884, were where one started one's preparation. For persons of a less practical bent of mind they represented both a description of the ethos of British government and a model for less fortunate systems. To some they embodied the substance of the British historical experience. During the past half-century Dicey's reputation as an authority on Britain has fallen dramatically, while his stock as an observer of Irish affairs has ironically risen. As British society has become more collect ivistic, her economy more service-oriented, and her politics more party based, he has been reanalysed and re-evaluated. According to the students of government, politics, administration, society, and law in particular, as they have become more professionally and scientifically oriented, Dicey, while he did much for Oxford,' did little to further the study of systematic history,. constitutional government, and political development. Only the party historians have been able to salvage anything from Dicey's scholarly demise. Not only has such analysis misinterpreted the basic character of Dicey's writings but also has mistaken his motives and candour in the name of science in the process. The analysts have assumed that studies in politics are either of an historical, theoretical, or practical nature, and that the character of Dicey's various efforts is easily apparent. In general, each work is essentially of a genre other than that of the investigator. For example, for the constitutional lawyer, schooled in court practice, The Law of the Constitution must be a work either in theory or history.
