Tujuan penulisan ini adalah untuk menjelaskan pelaksanaan pemberian izin usaha pemanfaatan hasil hutan kayu pada hutan tanaman industri kepada perusahaan di Kabupaten Aceh Utara dan untuk mengetahui akibat hukum terhadap penerbitan izin yang tidak sesuai dengan peraturan-perundang-undangan. Hasil penelitian menunjukan bahwa pelaksanaan pemberian Izin Usaha Pemanfaatan Hasil Hutan Kayu Pada Hutan Tanaman Industri terhadap perusahaan di Kabupaten Aceh Utara bertentangan dengan peraturan perundang-undangan yang berlaku. Pemberian Izin Usaha Pemanfaatan Hasil Hutan Kayu Pada Hutan Tanaman Industri kepada Perusahaan tersebut diterbitkan dalam periode otonomi khusus yang berbeda. Kewenangan untuk melakukan pengusahaan dan pengelolaan sumber daya kehutanan diberikan kepada Pemerintah Aceh pada periode otonomi khusus melalui Undang-Undang Nomor 11 Tahun 2006 tentang Pemerintahan Aceh. Akibat hukum dari penerbitan izin yang tidak sesuai dengan peraturan perundang-undangan adalah izin tersebut batal demi hukum. Disarankan kepada pemerintah Aceh untuk dapat memberikan Izin Usaha Pemanfaatan Hutan sesuai dengan kewenangan yang dimiliki, sehingga tidak merugikan investor asing yang melakukan kegiatan usaha pemanfaatan hutan di Aceh. Abstract - The purpose of this thesis are to explain the granting implementation of business license for timber forest products utilization on the industrial forest to companies in Aceh Utara district’s and to understand the legal consequences of the permit t ing issuance that are not in accordance with the rules and legislation. The results showed that the granting implementation of business license for Timber Forest Product utilization in the Industrial Forest in Aceh Utara district’s contrary to the legislation . Business license granting for Timber Forest product utilization on the industrial forest to the Companies were issued in different periods of special autonomy . The authority to conduct utilization and management of forest resources was justgiven to Aceh Government on special autonomy period through the enactment of Act No. 11 of 2006 concerning Aceh Government . The legal consequences of the primitting issuance that are not in accordance with the legislation are the permit is void ab initio . It is suggested to the Aceh government to be able to give Forest Utilization license in accordance with the authority, so it does not harm ed foreign investors that are conducting forest utilizationin Aceh.
