- W3146027655 abstract "In spite of epistemological differences there is a striking structural similarity between evidentiary reasoning and legal argumentation. This similarity becomes particularly vi sible in recent developments of the theory of evidence and, on the other hand, the theory of legal reasoning. This is in our opinion due to the fact that reasoning is in both cases a part of a decision-making-procedure. The so-called questions offact express uncertain ty about some decision-making parameters pertaining to the f actual premises of the decision; the same can be said about the questions oflaw but here the uncertainty pertains to the norm premises of the decision. The similarity is not solely due to the complex intertwinement ofls and Ought in judicial contexts, although this is an important part of the problem. In legal language many facts are institutional — their understanding and Cognition presupposes the normative context be taken into consideration. When one has to prove valid contracts, criminal intent, causation, etc., even evidential reasoning continuously oscil lâtes between questions of fact and questions of law. On the other hand, when one is applying (interpreting) law, at least in judicial contexts, one is comparing different in terpretation alternatives with the more or less settled facts of the case. E.g.: A pushes B who stumbles and becomes severely injured. When one interprets such expressions as negligence, intent or fact-descriptions of criminal law (assault or not), one has all the time the concrete evidence in mind." @default.
