Закрепленный в ст. 2 ТК РФ названный отраслевой принцип трудового права определяет концепцию нормотворчества в сфере труда. В статье отмечается расширение сферы договорного (коллективно–договорного и индивидуально–договорного) и локального регулирования трудовых отношений. Автор приводит примеры локального нормотворчества и договорного регулирования трудовых отношений, обращая внимание на отдельные положения, которые противоречат действующему законодательству либо нуждаются в совершенствовании. Делается вывод о том, что на выявление противоречий и недостатков в правовом регулировании социально-трудовых отношений должно быть обращено особое внимание контрольно-надзорных органов при осуществлении государственного контроля (надзора) за соблюдением трудового законодательства и иных нормативных правовых актов, содержащих нормы трудового права. English Abstract: The Author draws attention to the implementation of such a basic principle of legal regulation of labor as a combination of state and contractual regulation of labor relations. Enshrined in article 2 of the labor code called the sectoral principle of labor law defines the concept of law-making in the field of labor. The article notes the expansion of the scope of contractual (collective-contractual and individual-contractual) and local regulation of labor relations. The author gives examples of local law-making and contractual regulation of labor relations, paying attention to certain provisions that contradict the current legislation or need to be improved. It is concluded that the identification of contradictions and shortcomings in the legal regulation of social and labor relations should be paid special attention to the control and Supervisory authorities in the implementation of state control (supervision) over the observance of labor legislation and other regulatory legal acts containing the norms of labor law." @default.
