- W3157294342 abstract "The contribution delves into one of the controversial aspects of the Bosphorus doctrine, namely, whether a State act is necessary for the doctrine’s application (the so-called state involvement requirement). Some ambiguities in the Strasbourg court's case-law thereon are illustrated and a typology is drawn. Firstly, where a national act implementing, applying or enforcing decisions of international organizations is under review, the Court has no difficulty to confirm its ratione personae jurisdiction. Secondly, where the State has intervened by submitting (or refusing to submit) a request for a preliminary ruling to the ECJ/CJEU, such State involvement is usually treated as bringing the dispute within the ratione personae ambit of the ECtHR’s jurisdiction. More complex is the case of activities of international organizations not requiring an intervening State act. In such situations, the Court distinguishes between cases where structural deficiencies are at stake from cases where other violations are raised. While by no means bereft of controversy, it is argued that this distinction has allowed the Court to expand its monitoring to the most serious cases of human rights deficiencies within international organizations, while holding back in all other cases. Moreover, while the Court has repeatedly argued that the presence of an international organization’s seat in the territory of a member State or the membership itself and the State’s participation in the decision-making procedure do not constitute sufficient links for fulfilling the criterion of State involvement and establishing the Court’s ratione personae jurisdiction, it seems to have exempted from this rule those international organizations’ acts adopted through a purely inter-governmental process, where each member State enjoys a right of veto. Thus, the impact of normative control by member States over international organizations’ activities has perplexed the Court and remains one the ambivalent aspects regarding the State involvement element.
